中文摘要:
      学术自由的保障对象,是在大学与各研究机构从事学术工作的人员。在学术自由的制度性保障之下,大学自治除了排除外部势力外,另一个核心是自治事务应由与大学的学术自由具有直接利害关系的大学内部成员共同参与决定。有关大学教师的聘任与解聘事项,应为大学自治的人事自主之一环。非有法律明文规定解聘事由,大学教师不得解聘。
英文摘要:
      The objects of academic freedom guarantee are the personnels engaged in academic work in university and research institutions. Under the institutional guarantee for academic freedom,in addition to exclude external forces,the other core of university autonomy is that the autonomous transactions decision should be made by the internal members,who has a direct interest with academic freedom in university. The employment and dismissal of university teachers should be a link of personnel independent of university autonomy. Without dismissal reason that the law regulated, university teachers' should not be dismissed.
